1. GENERAL PROVISIONS
1.1. These regulations apply to contracts for the provision of services consisting of:
organizing a sports event, concluded via the website www. spratanrace.pl.
1.2. Each customer has the right to be bound by a distance contract at the latest when expressing his or her will to be bound by a distance contract the opportunity to read and accept these regulations and is informed about his rights and obligations.
1.3. Location of sporting events, start times and route details for all events
events are available on the Organizer's website: www.spartanrace.pl updated daily.
1.4. The Customer is prohibited from delivering to Ulmus Enetrprise Spółka z ograniczoną odpowiedzialnością liability (illegal content, application to Article 8(3)(2)(b)Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2020.344, consolidated text)
1.5. In matters not regulated in the Regulations, they apply universally applicable legal provisions in the Republic of Poland.
2. DEFINITIONS
The terms used in the Regulations mean:
Organizer (hereinafter also referred to as the Seller): Ulmus Enetrprise Spółka z ograniczoną odpowiedzialnością with its registered office in Krynica Zdrój, 33-380 Krynica Zdrój, ul. Halna 7/6, REGON: 360 384533, NIP: 7010451512, NIP EU: PL 7010451512, entered into the Register Companies: National Court Register for the Capital City Warsaw XII Commercial Department under the number 0000533141.
Sporting event: a run, competition, or sporting challenge in which participation is required
Paid Parking.
Client: a natural person with full legal capacity, who is interested in concluding an Agreement for participation in the event sports or who has concluded the Agreement and is entitled to participate in sports event.
Agreement: an agreement for the provision of the Service concluded between the Customer and organizer, on the basis of which the Service is provided organization and participation of the Client in a sports event.
Participant: an adult who is entitled to participate in the event sports, as well as minors, provided they are submitted on start of a sporting event, the organizer consents to participation in the event signed by the legal guardian child (personal presence at the competition office of the participant required child and the legal guardian or custodian in possession authorization from the legal guardian and consent signed by him start the minor and confirm the identity of the guardian with a document with a photo are obligatory).
Customer account: maintained in the IT system and available via Internet, an individual account, password protected, assigned to each Client, to which only the Client has access, used for concluding a contract for a specific sports event.
User: a person who has an established customer account. Confirmation
Conclusion of the Agreement: individual confirmation of the conclusion of the Agreement for participation in the event sports, sent to the Customer's e-mail address.
Force majeure: external event specified in detail in point 11 of the Regulations.
3. INFORMATION ABOUT REGISTRATION AND PRICES
3.1. The organizer requires payment of a registration fee, detailed in point 10.
Regulations for participation in a sports event, the amount of which depends on the date
registration for the event and the type of event. The organizer provides the entry fee amount at website, which is known before the conclusion of the contract.
4. CONCLUSION OF AGREEMENT, REGISTRATION FOR THE EVENT
4.1. The contract is concluded via means of distance communication
website www.spartanrace.pl, www.spartanrace.onlinesystem.cz
4.2. To conclude an Agreement for a specific sports event, the customer must have an account user, and is also obliged to complete the registration process on the one of his choice sports event in accordance with the Service Regulations.
4.3. In order to create a customer account, the customer is asked to fill out a form in which:
provides an e-mail address and password. During registration, the Customer consents to the processing his personal data.
4.4. After completing and confirming the data on the registration form, to the address provided therein A message will be sent to your email address indicating how to confirm your registration. When the Customer confirms the registration, the registration process ends, which results in the creation of a customer account.
4.5. The customer may not share his account login and password with third parties. IN
in the event of disclosure resulting from the Customer's intention or failure to exercise due care storing the password and login, the Organizer is not responsible for the use of
accounts by third parties.
4.6. It is possible to conclude a contract for the organization of a sports event after logging in
user account and selecting the country where the sporting events are to take place. Choice
country, causes available sporting events to be displayed on the website in a given territory for which the organizer allows registration.
4.7. If, when you make your selection for a sporting event, all the seats are left
exhausted, then registration will be impossible and the appropriate one will appear on the website message, however, the number of candidates is constantly updated, hence the user should keep track of the event data and if a place becomes available, the user will be there
could conclude an Agreement for a sports event.
4.8. Registration for a sporting event constitutes an expression of the customer's will to be bound by a contract distance. During registration, the customer provides the following data:
a) Gender,
b) Date of birth
c) Name, surname,
d) Residential address
e) Telephone number
4.9. Regardless of the data indicated in point 4.8, the user when registering for the event
Sports may provide additional information that is voluntary and does not influence the process correct registration, and their processing will take place in accordance with
the organizer's personal data processing policy specified in point 18 Regulations.
4.10 During the registration process, the user also provides the size of the SPARTANRACE T-shirt the organizer is obliged to provide it as part of the entry fee.
4.11. During the registration process, the user can purchase an additional "sms spartan tracking" service, the price of which is given immediately before expressing the will to accept the obligation payment by the user.
4.12. To complete the registration process, the user should confirm the registration process via use of captach security, as well as acceptance of these regulations and rules
participating in a sporting event.
4.13. Once registration is completed, the customer will receive an information e-mail from the organizer registration confirmation, which confirms registration for a specific event
sports.
4.14. The Organizer provides the Client with Confirmation of the Conclusion of the Organization Agreement sports event immediately after its conclusion, subject to point 7.2 of the Regulations, on the e-mail address indicated by the Customer, provided when creating a user account with the Regulations on the provision of services and the rules of participation in a sports event (race regulations).
4.15. The condition for taking part in a sports event is that it must be signed by an adult
participant, and in the case of a minor participant, by his or her legal guardian
an appropriate declaration, the content of which is made available on the website
organizer under the name "WAIVER OF CLAIMS, RELEASE FROM LIABILITY,
OBLIGATION NOT TO BRING CLAIMS AND PERMISSION TO USE
PHOTOS” and immediately before the sporting event.
5. WITHDRAWAL FROM A CONTRACT FOR ORGANIZING A SPORTS EVENT
5.1. Article 16(f), DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing the Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council (OJ EU.L.2011.304.64): Member States cannot provide for exceptions to the right of withdrawal the right to withdraw from the contract specified in Art. 9–15 in relation to contracts concluded remotely and contracts concluded off-premises in
following cases of delivery of goods which, after delivery, due to their character are inextricably linked to other objects.
5.2. In the event of concluding the Agreement via means of distance communication
(website) specified in the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2020.287, consolidated text), the Customer who is a consumer may withdraw from the contract without providing reasons within 14 days from the date of conclusion of the contract, taking into account the provisions of Art. 29 Consumer Rights Act. For this purpose, the Client should submit a declaration about: withdrawal from the contract.
5.3. The template of the declaration of withdrawal from the contract is indicated in point. 17 of the Regulations. The consumer should send the declaration of withdrawal to the following e-mail address: info@pl.spartan.com.
5.4. If the performance of the Agreement is to begin before the deadline for withdrawal expires A customer who is a consumer is obliged to submit a contract concluded remotely
To the Organizer an express statement containing such a request via
e-mail to: info@pl.spartan.com.
5.5. When submitting the declaration, the Customer may use the following template, specifying the type
sports event, its date and providing your name and surname: "In connection with the conclusion of Agreements for the organization of a sporting event ……………. (specify the type of sporting event and date of the event), I declare that I demand that the execution of this Agreement begin before the deadline to withdraw from the contract expires. ……(give name and surname).”
5.6. If the consumer exercises the right to withdraw from the Agreement after submitting the above request, is obliged to pay for the services provided until the withdrawal from the Agreement. Amount payments are calculated in proportion to the scope of the service provided, taking into account the price or remuneration agreed in the Agreement.
5.7. The right to withdraw from the Agreement is not available to the Customer who is a consumer in the event of when he used the Service in its entirety before the expiry of the 14-day period referred to in point 5 (5.2) of the Regulations.
5.8. If the Customer withdraws from the Agreement, the organizer refunds the amount
paid by the Customer within no more than 7 business days, to the bank account
indicated by the Customer.
6. REGISTRATION OBLIGATION AND TEAM REGISTRATIONS
6.1. The seller is obliged under the contract regarding the registration price from the moment
confirmation of registration electronically, provided that the consumer fulfills it conditions specified in these Regulations.
6.2. Customer registered by the team captain as a team member for a given race (hereinafter referred to as "Team Player") consents to the team captain to make such registration (hereinafter referred to as "Team Registration") and to make changes to Team Registrations. Competitor The team does not have such registration by the captain in its registration profile team, and therefore has no right to make any changes to this registration.
The Seller, at the e-mail request (XXX) of the Team Player, reserves the right to transferring her/his Team Registration to Individual Registration (in your own profile personal data of the Competitor in the registration system).
6.3. The team captain has the right to change the Team Registration applicable to
all team members (Team Players) registered in the team profile, and on his request, all team members may be transferred to another race.
6.4. The player is registered individually in the team (creating his/her individual profile in
registration system) has the right to postpone his registration (deferral function) to another one race after its consideration, using the registration system according to the rules specified
in art. 10.3. and art. 12 of these regulations
6.5. The reverse is signed by each band member individually.
7. PAYMENT TERMS
7.1. In case of payment via the online payment system, the customer will receive a confirmation payment immediately after its execution.
7.2. In the case of payment by bank transfer, the Customer will make the payment immediately after confirmation registration, but no later than within two (2) calendar days. The customer will receive e-mail confirming payment after acceptance by the Seller.
7.3. If the Customer requests the Seller to issue an invoice or tax document
regarding payment for running with personal data as a natural person - entrepreneur or
legal entity, the Customer is obliged to enter billing data via appropriate link in the registration form, before confirming your registration. if a natural person - an entrepreneur or a legal person - does not enter data billing in the registration form, the Seller will consider the Customer to be a natural person running a business. It will be issued in the registration system a tax document with data of a natural person for an entity that is not an entrepreneur.
8. SUBMITTING A COMPLAINT AND HOW IT IS HANDLED
8.1. Complaints regarding the provision of the service for which the contract was concluded may be made submit in writing or electronically.
8.2. Complaints should be submitted in writing in traditional form by sending it to the registered office address organizer or to the e-mail address: info@pl.spartan.com, specifying in the subject of the message:"Complaint".
8.3. The organizer responds to the complaint within 14 days of receiving it.
8.4. The response to the complaint is provided in writing or on another durable medium.
9. RIGHT TO CHANGE THE COMPETITION TIME, CHANGES IN THE SPORTING EVENT
9.1. The organizer hereby reserves the right to change the date and place of the competition and company recording, counter, time counting, price offer, track, fee offer, algorithms
results, quantity, size and types of initial waves, type and size of goods, algorithms
results, website content or policies and instructions that it considers appropriate, as needed without prior warning.
9.2. The organizer reserves the right to inform about the changes indicated in the previous one point on its website, which is the source of the most up-to-date information
information.
9.3. In the case described in point 9.1 of the Regulations, the Customer has the right to participate in the event sports event on another date proposed by the Organizer.
9.4. The Organizer reserves the right to refuse the right to start to a Participant who finds
under the influence of alcohol or intoxicating substances, aggressive, in costume
threatening safety and taking any action that may threaten the health or life of other Participants, representatives of the Organizer and sponsors and event partners. In such a case, the Participant has no right to demand registration fees.
10. REGISTRATION FEE
10.1. Participation fee:
The Seller will collect a Race-related Participation Fee, which will cover direct expenses
related to the actual organization of the race, services, obstacles on the race track,
refreshments (if available), medals, T-shirts, etc. (hereinafter referred to as "Fee for
participation"). The participation fee may be different for each category races and may vary depending on the registration time (gradual price increase starting point), however, the Client knows the final assessment of the participation fee before being bound by a payment order.
10.2. Non-refundable registration administration fee:
The Seller charges a flat, non-refundable corresponding administration fee
Seller's administrative costs which are effectively used to cover costs related to the registration process (hereinafter referred to as the "Administrative Fee"). Fee Administrative covers the Seller's necessary expenses related to the Customer's registration central register of participants for each competition separately and the costs of license fees related to the issuance of a registration number (BIB), which are borne by seller automatically after starting the registration process, regardless of the seller it selfsporting event. The funds will be used for the benefit of the Client regardless course of the race. The administration fee is non-refundable except in the following cases: the race will be canceled by the Seller for reasons other than force majeure. Fee The administrative procedure is the same for all race categories and does not change due to at the time of registration (gradual increase in the registration price). Discount for points or others discounts do not apply to the Administration Fee. However, the seller may decide to granting a discount on the total fee, including the Administration Fee.
10.3. Registration fee:
For the registration fee, which is obliged to pay each person registering for the competition,
(concluding a contract for the organization of a sports event) consists of: Fee for participation and Administration Fee, which together constitute the total price for registration for the competition (hereinafter referred to as the "Registration Fee"). There is a Participation Fee and an Administration Fee booked separately and are listed on the invoice as separate items. The price that displays on Spartan website is the final price including the Participation Fee and Administration Fee. Any discounts or special prices apply only for the Participation Fee and do not affect the Administration Fee which remains is unchangeable and is booked separately unless the Seller grants an independent discount. If the competition is canceled for a reason for which force majeure does not apply, the Buyer may also require a refund of the Registration Fee or use the Registration Fee for next competition (deferral), unless the number of places in the selected ones is used competition, and the notification will be sent to the Seller at the email address: info@pl.spartan.com up to 14 days before the planned competition date.
11. FORCE MAJEURE
Force majeure is defined as unforeseeable or necessary and unintended events
or causes beyond the appropriate degree: Accidents, riots, epidemics, pandemic, quarantine, social unrest, failure of means of transport, failure of devices webhosting, failure of the Internet service provider, natural disasters, regulations of the government or other public authorities, statutory restrictions, changes in acts or other legal provisions, nationwide strikes, fire. For the new and an accepted circumstance of force majeure will be considered situations or causes when circumstances force majeure is already known at the time of registration, but the subsequent consequences associated with it leading to the inability to perform the subject of the Services.
12. CHANGE OF COMPETITION DATE
12.1. In the event of force majeure specified in these Regulations, with the occurrence
exceptional weather conditions that constitute a weather anomaly that makes it impossible
completion of the competition on the previously specified date, the Client will receive a voucher (deferral) in the amount of the Registration Fee paid (the amount paid during registration). To receive a voucher,The customer should contact the organizer by e-mail to the following address: info@pl.spartan.com issuing a voucher
12.2. The voucher is valid in the year of issue and the following year and can be used for:
any competition by the Client, but only at the same distance and level difficulties for which the Agreement for organizing a sports event was originally concluded. The voucher is used by registering for a new competition and then will enter the voucher number in the dedicated section in the registration interface.
13. COMMERCIAL INFORMATION AND RULES FOR THE USE OF COOKIES
13.1. If the Customer submits a voluntary declaration constituting a request to be sent to him
current information about the Seller's offer by registering in the appropriate field will be
it was sent to the e-mail address provided by the Customer. In such a case, the consumer expresses consent in particular to the sending of commercial information and information related to goods, services or activities of the seller to the consumer's electronic address. Client may request to unsubscribe from this service at any time without giving any reason by sending e-mail to: info@pl.spartan.com.
13.2. By using the User Account, the Customer consents to storing it on his computer
cookies that enable the provision of services. Lack of consent to cookies means that
some website functionalities may be unavailable. Changes to file settings Cookies can be made by the Customer on his/her own computer at any time.
14. DELIVERIES
The Seller fulfills all information obligations imposed by law generally applicable law, and arising from these Regulations towards the Customer implements in a manner appropriate to the type of means of distance communication used, i.e. via the e-mail address provided to the seller when creating a user account, unless The Seller and the Customer have agreed on a different method of transmitting and delivering information.
15. FINAL PROVISIONS
The Regulations are valid from 1.1. 2021.
Agreements between the Customer and ULMUS ENETRPRISE Sp.zo.o. are implemented on the basis of provisions of the Regulations in force on the date of conclusion of the Agreement. The competent court to hear disputes arising from the Agreement is the competent courtlocally for the client.

17. PROCESSING AND PROTECTION OF PERSONAL DATA, INFORMATION CLAUSE
17.1. The administrator of personal data is:
a) Ulmus Enetrprise Spółka z ograniczoną odpowiedzialnością with its registered office in Krynica Zdrój, 33-380 Krynica Zdrój, ul. Halna 7/6,
17.2. The Customer's personal data processed for the purpose of establishing, shaping, implementing, changing, termination and settlement of the Agreement, pursuing claims and for archiving purposes. With the consent of expressed by the Customer, the Customer's personal data are processed for own marketing purposes (informing about promotional campaigns, new sports events) regarding services provided by the Organizer
17.3. The basis for the processing of personal data is the Customer's consent, as well as statutory provisions authorization in the scope of:
a) processing data necessary to perform the contract with the Customer whose data is provided concern;
b) in the scope of taking actions preceding the conclusion of the contract - at the request of the Customer;
c) personal data whose processing is necessary to fulfill the obligation legal obligation applicable to the Personal Data Administrator.
17.4. Providing personal data referred to in the process of concluding an organization agreement sporting event (Gender, Date of birth, Name, surname, Address, Number
telephone) is voluntary, but necessary in order to conclude and perform the contract. Providing data (e-mail address and name and surname) in the process of setting up a customer account is voluntary, but necessary to create an account.
17.5. Providing other personal data not mentioned in points. 17.4 is voluntary.
17.6. As part of the implementation of the contract, the Customer's personal data may be transferred to the Partner appropriate for a given stage of contract implementation. A partner is a company cooperating with The organizer, i.e.

- ADVENTURED SPORT EVENTS S.R.L., Drumul INTRE TARLALE, Nr. 41C, BIROUL 24, Etaj 2, Bucuresti Sectorul 3, 032982, RO (“Spartan RO”)
and companies providing individual services necessary for implementation
Services arising from the Agreement, i.e.:
a) the entity organizing and ensuring the provision of the service, including the company performing the measurement
participants' time at the event;
b) the insurer with whom the organizer concluded an insurance contract for participants
sporting event;
c) entity providing accounting, IT and legal services.
17.7. The scope of personal data entrusted to the Organizer includes:
a) Gender,
b) Date of birth
c) Name, surname,
d) Residential address
e) Telephone number
f) Email address
17.8. The Administrator and the Customer may individually determine the scope of information submitted for processing personal data by the Customer.
17.9. Data such as: name and surname and place of residence of the event participant
sports are published on the paper and electronic participant list on the website
organizer's website.
17.10. The Organizer does not use personal data for purposes other than those specified in
Regulations.
17.11. Customers' personal data are processed for the duration of the Agreement, and after the expiry of or termination of the Agreement for a period corresponding to the limitation period for claims may be entitled to the Organizer and in relation to the company.
17.12. The Customer's personal data is not subject to automated decision-making, incl
profiling.
17.13. The Organizer ensures the implementation of Customers' rights arising from the applicable provisions regulations regarding the processing of personal data, including the right to access content the Customer's personal data and their rectification, deletion, restriction of processing, law to object to the processing of personal data.
17.14. The Organizer informs that the Customer has the right to lodge a complaint with the authority supervisory.
17.15. If data processing is based on the consent expressed by the Customer,
The Organizer informs that the Customer has the right to withdraw consent at any time
moment without suffering any negative consequences.
17.16. The Organizer declares that the processing of personal data takes place on-site
European Economic Area.
17.17. The Organization informs that it has appointed a data protection officer who can be contacted contact us by e-mail.
17.18. In the event of complaints or objections related to the processing of personal data
